    Georgia dual residency laws
    My spouse is employed full time in Georgia. I draw disability benefits from my Company and SS. My spouse will be retiring in months. We were planning on claiming SD as our legal residence at that time and will be "fulltimers" in a motorhome. However, due to a unique circumstance I have the opportunity to be in SD for the next months, ahead of my spouse. Due to airline employee benefits, he will fly for free, to where I am on the weekends and on his vacations (he gets 7 weeks). We will be purchasing an expensive motorhome next month, titled in both our names. We have been in Ga for the last 50 years and just sold our home. The sales tax on an RV is much cheaper in SD and would like to claim SD as our residence. I will be in the RV in SD, he in Ga. I will have SD Drivers Lic, he has to have a Ga drivers lic for his job. [B]Can we SD as our residence while he is in Ga and me in SD for this purchase? Also, since we file taxes jointly, which state do we claim for filing our federal and state taxes? Ga has an income tax, SD does not.

    You need to "establish domicile" in South Dakota to make it your tax home. Contact the local court house to determine what must be done to establish domicile.

    Once that is done, you will be okay.
