Ould I leave the state of KY and move else where with my child? A paternity test has
Ould I leave the state of KY and move else where with my child? A paternity test has been established who the father is , he filed visitation papers on me but he filed them wrong the judge told him if he didn't learn how to file them right then she guessed he just wouldn't ever get to see her , since we haven't been to court they said I'm not obligated to let him see her . He was ordered to pay child support but he was also sentenced to a 9-12month drug rehab program because he got caught taking drugs on parole.. and he's suppost to leave sometime in 1/2010? And isn't ordered to pay until he gets out of the rehab. So , could I get introuble for moving to another state where him and his crazy family couldn't find us?

You're going to have to ask someone from the local Division of youth and family services. Where in Kentucky do you live? How old are you and how olds the baby? I can look into it for you and see what you need to do. You don't want to take a chance until you know the law.

First off he can refile for visitation. If you try to disappear then you could be guilty of parental kidnapping. Why do you want to take the father out of the child's life ? As far as moving you could but if the courts grant him visitation they may also say your going to have to either return or give up the child.

If an OP gives the state for a general question that should be good enough. To go beyond that is against the rules here unless its really warranted. Please don't ask for locations other then general ones like State or Country.

So many issues, first the judge was a jerk, since yes of course he will get visit rights if he files correctly, and /or hires an attorney.
If you "move" without getting permission, he could file with an attorney within a matter of days or weeks and get a court order to force you to move back, so if you move without permission, it is a waiting game to see if he is going to file.
You have to expect he will get visit rights and to be honest I hope you are allowing him to see the child if not this will also go seriously against you if there is latter a custody battle.

He will only be granted supervized visitation , if he is granted visitation at all "they told me the courts have the right to take away ur parental rights if they can't follow simple ruls of the court like staying off drugs while on parole", I have a lawyer - the child's father is a drug addict , on parole , absconded from his probation and parole twice now , has a rap sheet 7 pages long... So no I'm not allowing him to see her AT ALL they told me I wasn't obligated to since there wasn't anything established in court yet... Him and his stupid mom are crazy and both use drugs and alcohol regularly and I'm in fear they will try to steal her from me even though neither one of them are capable of taking care of a dog little lone a baby...

1) Doesn't matter what type of visitation he may get. The fact is that he filed for visitation and can file again. For you to move without the permission of the court could get you in trouble with the court. Especially if you hide from him. That's parental kidnapping.
2) Courts can't just take away parental rights. I don't know who told you that, but they were not accurate.
3) If you have an attorney, why haven't you asked them these questions?
