    Can I appeal an unemployment decision?
    I was terminated Oct 1 for time clock violations. At that time I was also informed that I had threatened my supervisor on the social networking site Facebook. My exact words were "Is there a law or rule against kicking your supervisors A!@#? I never mentioned his/her name nor did I say MY supervisor. When I received the letter of appeal the HR rep from my former employer said that I was terminated for causing a hostile work enviornement (comment on Facebook) and secondly the time clock charge. The appeal judge found that I never cheated the time clock, but that I did cause a hostile work environment with my Facebook comment. Should I appeal the decision? As it stands now I have to repay $3900.00 and I don't have a job. I'm at a total loss here.

    You can appeal the decision. Of course, there's no guarantee that it'll go in your favor. Instructions for appealing should have been included along with the initial decision when it was handed down.

    I would always appeal, you can't win if you don't try.

    And with all of the worker violence, yes that could be considered a threat, you would be surprised at the people fired form comments on social web sites

    I have investigated a number of these. They are "implied threats." I have never seen one Unemployment decision overturned but I suppose it's possible. It wouldn't hurt to try.
