    Summary Judgment
    Someone used my credit cards to get cash. We filed fraud claims and all but one of the credit card companies settled out accounts. These were done almost three years ago. The last credit card company would not settled and we file an declaritory judgment action to have the court hold we were not responsible. Now the attorney for the credit card company has filed a summary judgment claiming fraud, theft and many other issued (250 page motion). In this motion he has asked for summary judgment on the two accounts that were settled almost three years ago.
    My question is simply how is the best way to go about defeating this motion? Since this case was filed my attorney has moved and I do not have representation.

    YOU MUST get immediate attorney representation if you didn't already miss the response deadlines. I am not an attorney but even with all my legal experience there is no way I would go it alone in the situation you just described.
