    USA Constitution
I live in a nursing home with severe diabetes. My question is, The USA Constitution says I have the right to religion. Can they legally stop me from going to my church for worship on Sunday?
    Sincerely,

First, you should not put personal info in a public message. That info has been removed for your protection.

The answer to your question is maybe. You really should read the Bill of Rights. Had you done so you might not have had to ask this question. The Bill of rights prohibits the GOVERNMENT from passing and enacting laws that inhibit the rights listed.

So, unless the nursing home is operated by the government, its not violating the First Amendment. Even if it is, your medical condition could be enough to justify not letting you out of the home.

Another issue is whether the home itself conducts Sunday services. If it does, then its not interfering with your ability to practice your religion, just where you practice it.

If you can give us more details about your situation we may be able to advise further.

    Hello t:

It's not really a matter of WHERE you want to go, but WHETHER you want to go. Unless you've been declared incompetent, they can't stop you from going anywhere at anytime. If they try, call the police. They'll free you.

Of course, if the rules of the home say you can't, then you'll have to find a new home that says you can.
