    Florida Squatting Law
    I am currently living with a roommate but my name is not on the lease with the landlord. My roommate is behind on the rent and I have been paying him in cash my portion of the rent. But the rent is actually always late even though I have been paying my portion on time, because he is so behind on the rent. He wants to kick me out. What rights do I have to stay in the apartment since I have been paying my portion of the rent. The only thing I have that says I live in the apartment is that my mail has been coming there since July and the Comcast Service is in my name for the apartment.

    Can the police or the landlord kick me out on the street since my name is not on the lease?

    You have no rights - you can take action against your roommate, of course, once he (and, by association, you) are evicted because he has collected your rent money and not turned it in to the landlord.

    The landlord has not been receiving rent and is legally entitled to evict the tenant - your roommate. You are collateral damage (so to speak).

    He is the tenant, you are not.

    Does the landlord know you are living there?

    Yes the landlord does know I am living in the apartment and has instructed me to stop paying in cash and ONLY pay the rent in a Money Order/ Cashier's Check payable to the owner of the building. Referencing the apartment number and my name etc.
