    Husband got DUI, but it was me driving
    My husband and I were out last night, I was driving, we had been drinking. I was driving his car, its louder than it should be because it's a little sporty racing car. We passed a cop who was sitting on the side of the road eating lunch, he saw us pass him twice.. the second time he pulled out, and pulled us over... wondering why we were going back and forth. We were going to the gas station, and I left my purse at home, so we went back, and then attempted to go back to the store. Anyway, when the officer pulled us over, I panicked. I undid my seat belt and jumped in the backseat. Leaving my husband in his seat belt in the passenger side. (I know, I'm an idiot) The officer assumed he had been driving and got in the passenger seat. He gave him a couple sobriety tests, and then made him blow. He blew 0.08. The officer took me home and him to jail... Hes out today, was released immediately after he got there. He is in the military and had to be released to military officials. I have spoken with a few attorneys. I feel horrible that he took the rap for me. I want to let them know I was driving. If the officer had video of the whole thing, they will see me jumping in the back. My question is, we are getting an attorney, and I'm willing to tell the judge the truth, that I was in fact driving, not my husband. Can they turn around and charge me?? If so, that's more than OK.. he's just getting in sooo much trouble, mainly w the military.. bc of my stupid, careless, selfish actions...
    Anyone who can provide some advice, it would be more than appreciated, thanks in advance

    I'm wondering just how you attempted and completed jumping into the backseat of a little sporty racing car? Most little sporty racing cars are two seater models.

    And since when do officers give rides home being that nice? He would have let you drive the vehicle home yourself. Also, couldn't he smell the alcohol on your breath as well and figure you were drunk also?

    I drive a sports car. I have always driven sports cars. I work with Cops; I've dated Cops; I've lived with Cops.

    Sorry, you can tell the judge that as evidence in husbands defense, but they won't believe you most likely. At the scene is where the truth should have been told. Since they can't do a DUI test on you NOW, no proof of a crime.

    So most likely the DUI will stick, and hubby will now have serious issues with the military and may also get punished from there.

    I'd charge you with obstructing the legal process and any and all traffic violations that you did while you drove past me twice. You can't be charged with DWI at this point. I also question your truthfulness now. Could it be that you're not telling us the truth now?
