    UK spouse visa to indifinate leave to remain
    Hello,

    Would someone help me with the question below?

    If someone wants to file a divorce or starts a procedure in UK while on spouse visa (just about a year and half on a spouse visa), would s/he still be granted Indifinate leave to remain?

    Also, how quickly can they divorce if they are agreeable to facts? No children or assets involved.

    It is a condition of entry for a limited leave to enter visa that the relationship is subsisting and you live together as husband and wife. If this ceases to happen then the visa automatically becomes void and the holder should return to his/her own country.
    If both agree to the divorce, it can be done in 6-8 months.
    It is also the sponsors legal obligation to inform the UKBA of the breakdown of the relationship.
