    Does statute of limitation pertain to state your in or state that you obtained credit
    Well, I was served in January 2008 that I was being sued by Capital one. I turned in admissions and disclosures advised and nothing happened up until July 2009 when I received a document that Capital One had a new lawer on the case and that lawsuit would be dismissed if no one appeared to request that it be resumed. Apparently the new lawer requested a court date. Then I received a letter a few days ago saying that I need to appear in court for a "final contest" on December 7. Of course I am freaking out, I thought everything was over. This card was obtained in Utah 2003 and has been delinquent since 2004. I paid off some Capital 1 cards. I don't know if this one of them. First of all can I request that lawsuit be dismissed on grounds that statute of limitations is up? Also does the statute pertain to Utah statutes since obtained in Utah? The document says :Capital 1 vs Carol Woodcock, Is that the actual company or could it be a collection agency that bought debt suing?

    This should be combined with your other thread - it's all the same lawsuit.
