    Break up leads to a verbal agreement in court.
    I live in, Virginia.
    I was dating a girl, who over a period of two days, gave me close to 1,600.00 dollars.
    To make a long story short, I broke it off with her and went back to my ex-girlfriend.
    Before I knew it, I was being served to go to court.
    She says the money was a loan and we made a verbal agreement for me to pay it back.
    Also she is asking for six percent interest on it.
    How difficult is it to prove a verbal agreement?

    You will have one heck of a time convincing a judge that she made a gift to you of $1600. I do not believe she is entitled to interest but the judge can award her whatever he feels is fair. What did you think was going on when she gave you the money, were you in a bind at the time like rent due or car loan?

    You will also have to prove it was a gift, so often no real proff and the judge will have to go by his feelings in small claims court as to who he thinks is telling the truth.

    So ask a dozen people if they think someone would gift 1600 dollars, I would say most of the answers would be no.
