    Parental Rights
I currently live in Florida with my child and need help. My ex-husband is abusive (physically and mentally) with our son. He has not paid child support in 5 years and doesn't want to see our child. What do I need to do to have his rights removed by the state?

Remarry and have your new husband adopt. Sorry, but that's the only way its likely to happen.

Courts are VERY reluctant to issue TPRs. Generally they will only do so to clear the way for an adoption or if the parent is a danger to the child. So you might argue that he is a danger since he both physically and mentally abuses the child. But since he wants nothing to do with the child and does not have or exercise his visitation rights, then that wouldn't apply.

Since he isn't exercising visitation, what advantage to you think terminating his rights will give you?

By the way there are thousands of threads in this forum that deal with this issue. I suggest browsing through some of them to learn more.
