    Theft under 5000, second offense
Three years ago, I got caught shoplifting a package of beef jerky. I was charged with theft under 5000. It was my first offense, and with a lawyer's help, successfully pleaded not guilty. I have no criminal record currently. I had to attend an anti-shoplifting seminar, write a report on it, as well as make a formal apology.

I should have learned my lesson back then. But unfortunately, being the idiot I am, I didn't.

I recently was laid off from my job. Being depressed, and having no money at the time, I attempted to steal a bottle of alcohol from a local liquor store. I was approched in the parking lot and confronted by the staff.

At first I denied it, being scared or getting caught, but I realized I better fess up. The woman said they wouldn't call the cops if I just gave it back, but that really doesn't matter now. I handed back the bottle and after many angry looks from the clerks, we parted ways.

The next day, an officer shows up at my house, saying I'm being charged with theft under 5000. This is my second offense, and I'm very scared. I feel bad for what I did. I know it was wrong, and I know getting laid off is no excuse to steal.

I want to know what sort of punishment I am looking at for my crime. I have an anxiety disorder, and this is really eating me alive right now imagining going to jail or something. I really have no idea what to do. What do you think will happen to me? Should I plead not guilty and get a lawyer? Will I be fined? Will I have community service? Do you think there is any chance I can beg the store to drop the charges?

What should I do? What will happen?

(EDIT: More info about me. I am 24, and live in BC Canada)

If you successfully pleaded not guilty, then you did NOT commit any crime.

So, this is your first legal offence.
