    Relocation out of state
    I currently live in Arizona. I am the primary custodial parent for my children. The children's father relocated to Pennsylvania 3 years ago and has visition 2 times a year with the children. Our current parenting plan states that neither parent will move with the children more than 50 miles from their current residence without prior written consentof the other parent, or a court ordered parenting plan. I have the opportunity to relocate to another state for better opportunities. I have asked for my ex/children's father for written consent and he has not given it to me yet? What legal steps do I need to take next? I am also questioning why I would need his written consent since he no longer lives in the same state where the court order was established. He doesn't even live in the same state as the children? My move would actually not affecting any of his visitation time and, it would be closer to the state he lives in right now. Do I actually need his written consent since he doesn't even live in Arizona anymore? Could I just give him written notification of the relocation of myself and the children? I have also answered all his questions in regards to the location and he has still not given consent?

    If the papers say you need his consent then its best to go that route for the time being until you reach and impass. Once at impass if your still not satisfied then seek the courts approval and be prepared to explain how visitation will be kept up.

    Example: If both parents had agreed to meet 1/2 way or split plane fares to make visitation happen then that shouldn't change so long as the distance isn't any further. In your case whatever you two had agreed upon before should be OK. Just be tactful about it and try to follow the court orders.

    How long has it been since you both have been discussing it and trying to come to resolution ?
