I recently caught my husband cheating on me after I filed the I-130 petition. We have to kids under 3 years old and he kicked me out of my home and currently has my 2 year old son because he said he would accuse me of kidnapping. I let him stay with my son but only because I did not want any charges filed against me because I am in the U.S. Army. What can I do or how can I have him deported. I do not want him getting custody of my kids and then all of sudden he takes him to his country.

Generally speaking, there is no grounds for deportation based on being a bad husband, the exception being domestic violence. If you no longer want to be married to him, divorce him.
