This is a monster of a question. I am remarried, she is remarried. I have one child who lives with my ex wife. I have a new baby. She has moved away to another state about 1 hour farther away from where I live. I have been unable to visit my child as much as we planned before she moved. I now only see her 2 times a month versus 3 times a week before she moved. I want her to help with the drive. She is saying it is not her job. Now she wants to go to court. If we revisit child support how will it effect me. She is employed and so his her new husband. My wife is unemployed at the current time. There is so much more to this but I just want her to meet me half way on the drive. Any ideas?

If you had a custody order in place and she moved without the permission of you and the court then it is her responsibility to account for the differences. If she wants to go to court, by all means, go. You're the one in the right here.

As for child support... that depends on what the outcome of the new visitation order is and if your income has changed significantly since the last order.

She had the legal right to move or so my attorney told me. I had moved out of the state prior to her move so I could stop commuting 4 hours a day. I reduced my commute but lost my rights probably. We have joint custody and I have full and liberal visitation. I can see her as much as I want. I just have to leave work get there at 8pm spend 1 hour and drive back. If I did that now it would be midnight before I got home whereas I was able to spend more before.

Each state has it's own support calculation formula so with out knowing that we can't help you at all. However, to get an idea of what you would be paying you can find your states support calculator online and input all of the information it asks for and it will spit out a number for you to give you an idea. Do you have an actual visitation order from the court? You might want to have that revisited anyway because if all it states is whenever you want that isn't a very strong order especially with her being farther away from you you will want something more concrete like every other weekend or something.

Yeah - if she had the right to move, you don't have much of a case. In the hearing you can request a more specific schedule including overnights and weekends if you choose. Chances of an order to help your commute are not great.
