    Statute of limitations on possession of stolen property
    My nieces husband was driving a dirt bike that belonged to my son on a road. He was stopped by the police for riding on the road. My son went to the police station as requested by the police. When we finally left the station, my nieces husband was told there would be no charges against him, but because the bike my son had purchased was stolen they were not sure if they were going to press charges against him or not. I need to know what the statute of limitations in Ontario, Canada is for possession of stolen property. How long do the police have to send a summons to appear in court?

    Statute in Ontario is six years from possession of property.

    Hello chull:

    It applies, because it's the answer you were seeking... It's the SAME answer the cops were seeking too when they asked the crowns attorney the same question.

    The statute runs from the time the crime is reported till 6 years from that date. If the situation that you're describing happened WITHIN that 6 years, you can expect charges to be filed.

    You asked how my previous post applied to your question . You asked what the statute of limitation was in Ontario, I said six years, failed to put in 'for stolen property'. You asked how long the police have to send a summons, I suggest you call the police department and get more information.
