    Temporary restraining served by husbands girlfriend
    I was served by my husband a restraining order his girlfriend filed against me.

    Should I fight it or just leave it alone?

    We both have texted each other several times, she is stating its just me. I have proof of her text (in) & mine (out) and phone#'s from a phone bill.

    I told her & my husband a few times that I did not what her anywhere near my house, she again came in our car and sat outside our house, so I was upset and told her I would break the window next time.

    I stated that I would kick her @@@.

    I put info on Facebook to some of her friends to watch out she steals married men.

    Can I file a restraining order against her to stay away from my house and stop provoking me?

    I had told her we needed to stop, that I was deleting her ph#, I had not talked, text... nothing & even according to her the last time I did anything was on 8-28 but she filed on 9-18.

    I'm confused here. Just how could the girlfriend get a restraining order against you and have it "served by my husband"? Is this a legal paper issued by a Judge or just something that she made up and had him hand to you? Usually there would be some sort of police report involved for a judge to issue a restraining order against someone.

    If anything, your husband needs his head examined for even seeing this woman when he already has a wife to worry about.

    A restraining order can work two ways. It prevents you from bothering her, but it also prevents her from going near you without negating the order.

    Therefore, I would not try filing a counter order. Then you would have to explain why you were cyber-stalking her and issuing threats to her.
