    Move Away Case - parent moves back?
    My case was considered move away. Initially custody was taken from me. After Appellate and Supreme Court, I got joint custody. I returned to California and through mediation got 50/50 time (mon/pm to fri/am and friday/pm to mon/am) share, with father still as primary.

    But now my ex is working 72 hour shifts (firefighter). Thing is sometimes those shifts include his whole assigned time with my 10 year old. So instead of the 10 year old being with the father, she is actually with the step-mother.

    I need an argument for change of circumstances. Is there any case law regarding a move back after a move away, that it alone constitutes a change in circumstances?

    What exactly are you trying to do ? You have made no claims of the child being in danger and his shifts are the nature of the work he does. So Im not quite understanding your question ? Are you seeking full custody because of his job ?

    The step mother is still a mother... just not blood related... So, why do you feel this is a problem. It's good that they bond.
