    Foreclosure, prequalification and denied paperwork
    Okay, Im at my wits end with my mortgage servicing company ASC (owned by Wells fargo) We've been trying to modify since last year and everything we would call to find out something, they would tell us to resend the info (W@, paystubs etc) and we did it up until this year when we just ran out of money. We were never late on a payment AT ALL!

    So the house went into preforeclosure and was scheduled for foreclosure tomorrow. We met with A HUD counselor who spoke to ASC and they decided that NOW we would prequalify for something called HAMP and we were to wait 10 days for the paperwork.

    We did and never received so I called and they said they would resend it again! We received a letter on Sept 1 saying that they are reviewing the info we submitted but UH , we never receved the HAMP packet after asking 3 times therefore never submitted paperwork. We went to court and they said everything was on hold until further notice...
    I called today to return a phone call to ASC and was told my house forecloses tomorrow... WHAT I thought. I explained to them everything I wrote in this message and They called the attorney who said she's right, NO foreclosure tomorrow... SO I asked for the paperwork again and they said they couldn't send it from this particular dept.

    Now here's the kicker... 30 minutes later got a call from the company saying your house is being sold on the courthouse steps tomorrow... YOU HAVE TO LEAVE... WE explained again and again they had to call the attorney... but this time they said we were denied the HAMP program on August 22nd based on the info we sent in... BUT we have a letter from Sept 1 saying that they are reviewing and will be in touch... IM so confused... Im sure they don't want to help me BUT WHY... DO I have any legal grounds to consult an attorney based on being denied paperwork etc

    Do you don't need legal grounds to consult an Attorney. Whether you have case depends on whether you have been damaged by someone else's mistake.

    I would beginning calling Attorneys NOW and get in to see one as quickly as possible. If you don't have someone in mind, call your local Bar Association for a referral. NOW!
