My son is 9 months old, he lives with me and my boyfriend. My son's father only saw him maybe 2-3 times since he has been born. My son has been in and out of doctors office's because he has reflux. Not once has he given me money or called to see if my son is ok. One of the father's sister works with me, doesn't talk to me but the once in a while (i need something, how is the baby). I filed for child support in the begining of the summer, he got really upset asked his sister if she can talk me out of it, because he isn't working since i was about 4 months pregnant, therefore he doesn't have any money. But he ownes two homes, a nice truck and a bmw that he had mention he shares with his older brother.

He now served me papers delivered to me job! wanting to fight for joint custody, and dna. The dna was already done threw the child support office. I've always told him he is more than welcome to have visitation all he wants, but i don't want to have to shear custody.

My main question is:

Should i agree to joint custody? And if i do can i ask to have full parental rights?

or

Is there a chance of getting sole custody? with out getting to expensive.

Joint custody is not usually something you agree to. If he is requesting it, there is almost no chance its not ordered. Joint legal custody only means that he is entitled to have his equal say in life decisions.

Full parental rights isn't a thing. You either have rights or you don't. You currently do.

As for getting sole custody - again, if he is there fighting for it, chances are no, you don't have a chance of getting it. Especially without it getting expensive.

So you never went to court for child support? That would be the number one reason you haven't gotten any money from him... he dosen't owe anything until the court orders it. If he wants visitation the court will order it and he stands a chance at joint custody as well. Custody comes in two forms legal and physical. Legal means he has a say in the child's life and physical means the time with each parent is split. Many people have joint legal custody of their children, joint physical custody is harder to come by however. So, if he goes to court then yes he will get visitation and chances are he will be awarded with joint legal custody. You need to file for support if you want any help financially.

Sole custody kind of Depends on your circumstances. My daughter tienes 4 in May, her sperm donor just went back to prison. He hasn't seen her in over a yr, hasn't paid child support in over a yr, so the judge had no problem what so ever giving me sole custody. Have you talked to an attorney?
