I have a 26 year old stepson who, after and before he served some time in prison for probation violation, has lived with us. He has stolen from me and destroyed parts of my home and has been a general pain. I have bent over backwards to give chance after chance to get him out on his own. I want him out of my home and not have to hear a bunch of you can't do this and you can't do that. I am retired and 65 my wife still works and we cannot keep supporting him and worry about when we leave the home finding half of it gone when we return. Can I legally evict him and how?

Your son is an adult. Is he paying you rent? If he isn't, I don't see why you can't just change the locks. I live in Canada and I'm sure the States have different laws. Hopefully one of our law experts will be along soon to answer this question.

If he is receiving even one piece of mail at your address then you must evict him like a tenant, that is what he is, even if he is not paying rent.
