    Breaking parole
    When a person breaks parole and they are taken into custody... can they be released from custody by posting bond?

    Generally, there is NO bond for violation of parole.

    I was afraid of that. Is it true that they usually have to serve the time left when they break parole?

    Hello again, o:

    No. It just means they aren't eligible for release BEFORE their hearing... But, they WILL have a hearing at which time the violation will be sustained and a sanction given, or it will be dismissed...

    If the violation wasn't great, the person might get reinstated on parole. Or if it was serious, they might get sent to prison for the rest of their sentence.

    Thank you... this is a woman with young children... she has a felony conviction for stealing money from her employer and has now been accused of doing it again with another employer. From what I now understand... she will wait in the city jail until the hearing... Is there a time limit on how long they can wait before the hearing?

    No.

    The good news is, she cannot be violated for just being accused. If she's convicted of the new charges, she'll be violated for sure. She may be in jail on the new charges right now. Do you know?

    Yes, she is in the county jail with no bond on the new charges. I am wondering how long they can let her sit there with no hearing. Specifics... she is on parole for embezeling (?) over 200,000... probation for ten years... I think... now... at a new job she is accused of taking 15, 000. When the charges were filed they locked her up with no bond. It looks like they may let her sit there for some time... I am wondering how long that might be.
