    Can he take my son?
    I'm a single mom in the military stationed in virginia, my sons father moved to las vegas after I kicked him out. He lives with his mother and 5 other people in the house. Come the end of the year I am deployable again he claims he has rights to take my son cause I'm deployable... my parents with be keeping my son while I'm away... my sone father has a criminal history of child neglect and can not keep a job longer than three months... can he really take my son?

    Has paternity been established in any way - is he on the birth certificate, is there an Order? Is there a Court Order concerning custody?

    Unfortunately he is the child's father and the next in line for custody. You certainly can request that your child be raised by your parents but unless you get into Court and find the father to be a danger to the child if the father wants custody he most probably will get custody.

    You need to consult with an Attorney - in the Military or private - NOW because these things take time.
