    Visitation after 5 years
    Hi,
    I moved away from my ex boyfriend 5 years ago and our son stayed with him. Every time I tried to get visitation he denied me saying if I wanted to see my son I would have to sign over custody to him. I have just been served with Adoption papers for his new wife - I want to see my son... Do I stand a chance? I will pay all back child support, I will do whatever I have to, I just want my son...

    Legally, he cannot keep you from seeing your son, as far as I know. I really don't have much info from your post, but have you physically tried seeing your son, or sending child support? Has it been that long since you've seen him?

    Does he think you pose as a threat to the little one? If it has been 5 years since you've seen him then it won't be easy (if by choice, meaning you should have had to be legally prevented NOT to want to see him), in some states it can be considered child abandonment, if you give a little more info it may be easier to put some info and advice out there.

    Then don't sign the adoption papers. Petition the court for an order of visitation. As you've said, be prepared to pay all chid support arrearages, etc.

    My ex hasn't seen our three kids since our divorce five years ago. They don't even know who he is. No child support from him either ever. Not even a card. Raising a child on one income is hard enough without having to spend money on legal fees. Look within your own heart for what's best for your son after so long. I know that my kids are stable and happy, he is nonexistant. I never talk about him, good or bad. Nor did I ever tell him he couldn't see them. That was his choice. At least you tried.

    He can't keep you from seeing your son unless he has full custody and you never filed for visitation. And as for the adoption papers, if you don't sign them, nothing will happen. She can't adopt your son unless you sign the papers. Depending on how old your son is, it might be a little difficult when he sees you after five years, but if you work hard, you can have a good relationship with him.
