    Separating but not married
    Hi there, I am splitting up from my partner of over 5 years and would like a question answered please.we bought our house off her mum and dad when they moved to spain.I had a house before we got together which I sold and the £70,000 profit I made on that I put down as the deposit on our house together.when I sold my place I was then moving into a fully furnished place as it was her parents so everything I had at mine I did not need so I gave it all away and moved in with nothing.could you please tell me where I stand.she says she wants exactly half of everything baring in mind she started with nothing as she lived there with her parents,I just think it was only right that I should at least get back the £70,000 that I put down ,I mean I think it would be unfair for her to walk away with all that and I walk away with less than I started with baring in mind that we have made equity on our house now so she would get half of that anyway.

    Ratman, I don't think your question can be answered simply on this board, I do know that it would be have been to your advantage, seeing as you put up a considerable of money, to have had an agreement in place before you cohabited.

    I do believe you should consult an attorney in the UK, as our laws in the US or Canada differ drastically from that in the UK. There is no such thing as a common law arrangement in the UK which would govern this type of situation.

    I may be wrong, and you should tune in for more advice from our posters as more will be forthcoming, seeing as I started it off.

    Thanks mate I will keep checking back.I will be happy to take the 70,000 grand and forget the equity let her have it but for her to say she wants half of everything I think is unreasonable,I just need to know where I stand.

    I am sorry that you are going through this experience. Tickle is correct in stating that you will want to check with the laws that govern the UK.
    One question that I do have is: when you purchased the property from her parents did you have any idea of the value of the property at that time. Was there an appraisal of the property and has the property been appraised today? Has the property lost value (most here have) or gained value?
    Also, is your name on the title/deed for the property?

    Yes I have made money on the property and yes my name is on the deeds.thanks for the answers
