    Collecting Back Child Support On A Child About To Turn 18
    Hi, I live in Texas and am currently collecting child support on my son who will turn 18 in about a month. However, my ex-husband owes approximately $40,000 in back child support. He said that he will continue to pay after my son turns 18 but I told him that I wanted to have our divorce amended (not sure if that's the correct word to use) and have him sign some type of legal document. My question is... is there any type of document that I can have him sign or will I have to contact the Attorney General's office. And, is it too late to try to make sure he pays the back child support he owes.

    So long as he owes it then your OK. Just be sure to check with your state if there is any cut off for collection. Many states allow it to last for a lifetime but there are a few that don't.

    You should already have a legal document. Its called the support order. Unless he is payoing support voluntary that is your legal backup.

    If you never filed for a child support order then you cannot get back support.

    Your support order is your back up. That will hold him to paying any arrears because if he dosen't continue to pay until the balance is zero you can take him back to court again to enforce the payment. However, because you didn't mention a support order, as scott said... if you didn't get a support order through the court then you are up a creek, it's too late now to get one.
