    K1 Visa queries
    Hi,

    I;m a 24 year old N. Irish male and have been dating a 20 year old american for the last 2 years. She has visited here twice and I have visited there 3 times, twice for 2 weeks and the most recent for 2 and half months. We got engaged on this trip and want to go the k1 visa route but we have a few queries.

    Our biggest concern is that since I left school at 18 I haven't had employment for the last 6 years or have drawn benefits so I have no job history or tax history and we are wondering will this go against us.

    Any advice is appreciated

    Your employment is not relevant, since you are not in the US. It is her income and savings that will be important for the affidavit of support.

    If you have a family of 2, she must show she makes at least $18,212 per year (125% of the HHS poverty guideline for 2009) for her to qualify to petition for you. She can show funds in the bank to make up the difference and also get a joint sponsor to file an affidavit of support.

    Well, if and when I go over there I'll be living with her mum. In the same house will be myself, my fiancée, her mum and her brother. Her mum will be my sponsor, so how much does she need to earn to be able to petition for me?

    Add the number of people in the household (2?) add two (you and your wife) and then check the I-864P for the minimum amount for a household of 4. it is 125% of the HHS poverty guidelines for that family size.

    Your M-I-L will need to show she makes that much to qualify to file the affidavit of support for your wife's petition. There are alternate qualification methods as well.
