    Student loan offset
    Hi The Dept Of Education is now I believe illegally taking money out of a small disability pension I get through The Office Of Personnel Mng. The amount of the disability check I receive is about $350.00 per month, and they are deducting a additional $87.00 per month out of this.This monthly check is clearly for disability and or is related to a death benefit I receive through my fathers employment. I am fairly sure that The Dept Of Education is not allowed to do this if the payment is disability related and is not over $750.00. They also have recently taken a $5090.00 income tax refund I received for the year 2004 which was for a adjustment in taxes that I was suppose to receive because my disability income that year was overtaxed.     I don't see this to be a tax question - contact the Department of Education, explain the circumstances, ask them. Even better, send them a letter and request a written response with a copy of any documentation/law.

    I cannot find the answer.

    My issue here is, if your dad was disabled, him getting the money makes it disability payment, You getting the money makes it a payable on death of each a disability fund set up for him but since this is not disability money for you being disabled, I don't see it being protected
