    Statute of limitations for small claim filing
    I am being threatened with a pending small claims case for work done back in 2003. The service provider is stating there are unpaid invoices - which he admits he was sending to the wrong name and that were then returned to him (though the bills we did receive were all paid). We know he is just trying to get extra money on the chance that we will want to avoid court. What is the statute of limitation in filing the case- is it 6 or 7 years. And- is it then from the date of service provided, or date of last invoice?

    It is from the date you last sent them ANY money.
    Them sending it to the wrong address doesn't make it any less that you owe them
    What state do you live in that makes a difference on the SOL.
    Do you have an 800 number for them?

    We are in WI. He shows that he invoiced us for dates of service in June, Aug and Sept- and that we had made some payments through that time. What are we responsible for?

    03 would be 6 yrs ago.

    Capitol one is sueing 2500 to 5000 from ten years ago with the statue of limitations what will happen not real sure
