    Evicting a tenant (no lease) in Montgomery County, MD
    I have a college student who's been living in my home for almost a year; there is no written lease. We agreed upon her being here until Dec. 2009. She pays her rent on time but ever since my daughter accidentally broke a cup that was sentimental to her and her small sentimental rug was accidentally ruined (I offered to pay for it) she has been disrespectful, for example, comes in at any time in the wee hrs. talks loud and wakes up my daughter and me, doesn't care if we're sleeping. And now she's gotten to the point wherein she won't speak anymore. I've asked her if we can talk but to no avail.

    I'd like to give her notice to move out in 30 days. Is this legal?

    Yes. Since there is no lease, she is considered a month to month renter. Some states will require you give the full rental period (from the 1st to 30th) plus the remainder of this month.

    If she fails to leave after her 30 day notice, you go to court and have her evicted.

    Well, I don't know. You appear to have a verbal lease with an expiration of Dec 2009. If she can prove that agreement, then she is not a month to month tenant.

    Unless she doesn't pay the rent or otherwise interferes wiuth the household, I'm not sure you have grounds to evict. You can ask her to leave, but I'm not sure you can force it.
