    What rights do I have
    Hi,
    I have 3 children and me and their father have been separated for almost 2 years. He was in and out of jail all last year. We agreed on divorce papers and I paid to have them done and now he will not sign them. I have turned him into child support enforcement but we have not went to court. He just had another baby with another woman. What are the laws for child abandoment? He has not supported them since we split up. Please help if you can!!

    You can continue to press for child support and that's about it. While at court, request full custody and no visitation.

    Please pay attention to the sticky notes at the top of each forum. There is one for this forum that addresses Abandonment and explains why it does NOT apply.

    You should be able to file the divorce papers without his signature. The court will issue a summons for him to sign, and may give you a default divorce if he refuses.

    As for support, just continue what you are doing.

    Do you have an order for support? I am guessing that you do because other wise child support enforcement wouldn't be able to to anything at all. You can go to court to ask for custody and him to have limited or supervised visitation using his jail time as the reason for your request.
