    Cotenant's breaking lease
    I had a random landlord/tenant question that I was wondering if you knew off the top of your head or could point me to where I could answer it quickly …

    There are two cotenants that are leasing a house from the landlord. The two cotenants have had a severe falling out and one wants to move out and the other will not agree or talk to the one that wants to move out. The landlord has stated if the one that wants to move out can get the other to agree, she will let her move out.

    The lease has the following clause …

    SUBLET: 13. Resident may not sublet residence or assign this lease without written consent of Management.

    The one that wants to move out just wants to be done with it but can't get the other girl to talk to her...

    Because both cotenants have signed the lease does management need the non-cooperating tenant's agreement in order for the other tenant to sublet her spot...

    Is there any other way to for the tenant that wants to leave to get out this situation with minimal damage?

    If they had a falling out why does the other one want them to stay?
    If it is simply because she doesn't want to be responsible for paying all the rent and utilities maybe finding someone to sublet to and introducing them might make matters easier.

    It's an issue that has to do with a former boyfriend of the one now dating the second girl... I am not sure why the other girl will not talk to her about it...

    I think getting a sublease would be the best solution... but I was wondering what the next step would be if they could not work that out?

    If both are signed on the lease, it's the landlord that has to approve a sublet, not the cotenant.

    She did say the landlord would if the other gave the go ahead.

    Yes, she said the landlord would let her out if the other cotenant would agree... but at this point she could not get the other cotenant to speak with her about it...
