    Creditor refuses payment
    I took out a loan on some wheels, when the first payment came due they where suppose to take it out of my checking account,well it did not happen. I waited 3 days and still nothing, so I called the company. The lady over the phone stated that if it did not go threw they would be notified in 30 - 45 days. I told the lady I would send a check fedex but if I due I need to know they would stop payment on the ach withdrawl she stated don't worry do not send a check and this will not effect your credit we will note your account. Next month came same thing I called once again went threw the same thing and was told the same thing. Third month I receive a notice they where going to sue me so I call once again they told me my checking account was not valid and asked for the info once again, so I asked them to give me what they had which what they had was all correct. So the legal department ran the check this time it went threw. By this time they said I owed 549.42 which I did not understand after missing only 2 months of payment which was not my fault. So the next month came they called me to collect the balance of the 549.42. I did the same thing gave them the same check info and thought notihng else at this time I stated I will just start sending checks instead of them pulling the money from my account. So I sent a check 2 weeks later to get back on track. One month later they called and said they never got the balance to the 549.42 by this time They put it on my credit so I called to speak with a supervisor he stated it was there screw and they would fix it. So now I get tranfered back to the legal department for the balance of the 549.42 I ask the women if they are messing up why is this effecting my credit basically did not want to hear anything I had to say and demanded payment right then I stated that I would send a check she stated that if I did not do anything over the phone right then they would send me to collection. I explained to her this has been a very bad idea and I would send a check she stated that if I do this it will go to collection. What do I do at this point.

    First document all your calls. I hope you have dates and the names of people you spoke to.

    Second, you send a letter to the creditor telling them that you have been trying to get this straightened out since day 1. And that you are very upset that they are affecting your credit due to something that is THEIR mistake.

    Tell them if they don't fix this immediately and remove the reports from the credit bureaus you will report them to whatever regulatory authority they report to.
