I have a friend of mine that is on the final months of her 1 1/2 year probation for a DWI charge. She has completed all requirements that the court assigned her. She is a wonderful woman and has learnt her lesson. Her parole officer advised her to write a letter to the judge to seek permission to attend a wedding out of the country in the Domenico of Republic.The judge has responded with a denied response. Any suggestions?

Judge denied her request. There isn't much she can do.

Leaving the country is usually not granted regardless of what the occasion is i.e. funeral, wedding, job interview. The judge decided against her leaving the jurisdiction. There is virtually nothing she can do now but miss the wedding and send a nice gift. I would strongly advise her not to leave the country either as they just might visit her home, work on the dates she requested she be allowed to leave the country.

That's the way it works in my state (I was a probation officer for 7 years) , the judge has the final say in such matters because the judge placed the person on probation in the first place. HOWEVER if the person is in full compliance and has paid all monies, completed all programs, community service, etc. I would write the judge and ask him to terminate the probation early or place the probation in unsupervised status. In my state, if probation is made unsupervised, none of the normal restrictions or conditions apply, but if you get convicted of a new charge you have still violated probation. Try it-Make you best case and stress the need for the change in the probation and the importance of the need to leave the country to your family, etc. It may not work but you have nothing to lose!
