Getting married while a home is in foreclosure, Deed In Lieu requested
I am getting married on August 1, 2009. I have been working with Bank of America to possibly do a Deed In Lieu of Foreclosure for 45 days now. The 90 day mark would put us about 1 week past the wedding. My future husband is not on the mortgage. Is there any way they can go after him for the money I owe if we do not share any other debts but have a joint bank account? We are trying very hard to keep his credit untouched.

That's a good question. I'd advise you to talk to a lawyer, or to your church some churches have people who know these things and would discuss it with you for free. I had a student loan that was in default before I married, and my husband did not have to pay it. Once you marry someone you become one. Unfortunately I was told any debt's you have they are combined. I've been paying on my loan and we haven't had any problems but one of my clients told me they took her income tax check because her husband owed back child support. If you'll accquire anything together it probably will effect him. You really need to discuss this matter before you wed. I would hate to see that happen to you after losing your home. You and your new husband arguing and having problems because of this.
