My stepdaughter has been told that Florida would take 85% of her income for child support. She is just now getting on her feet, and I want to help direct her in where to research this. Can someone help me? She has two children. One, lives with the baby's father's mother.The baby's father lives with his mother who has custody. So in a round about way, he is being supported by her support to the child. The mother lies for him, so everyone thinks he doesn't work. That's in New Jersey. The second child lives here with an Aunt. Of course the father doesn't pay any support here either. How does she go about getting the courts to go after the father? He does work! Also, can someone direct me to how to find out about how much she would pay?

85% sounds a bit high. But I am in Arizona, and they way they did my daughters fathers child support is take both our incomes, divide it equally, and gave me the diffrence.

But again, that's Arizona.

In Florida...
The child support laws of most states look at only a few factors, and you may find that your Florida child support award takes into account only:

•How much your ex earns
•How many children you have; and
•What percentage of time the children are under each parent's care and control

No state will take 85% of a person's income if it would put them below the federal poverty limit.

Has a paternity test been done for either child to legally establish who the father(s) is/are?
