Adoption without consent from biological father?
I was granted a no contact order from a family court of law for my 5 yr old son 3 yrs ago, his father has not seen him since he was 9 months old. My partner would like to adopt him now, do I need to gain consent from the biological father in order to do so, or does the no contact order give him no say in the matter?

No Contact does not mean he still does not have parental rights--unless they were revoked by the court at that time. You would need a family law attorney in your area to be sure---but I'm betting that you'd need him to relinquish parental rights in order for your husband to adopt. (Most states require that you be married a specific amount of time before they will grant adoption) |
