    Need your help
    Hi,
    My brother is going through a nasty divorce. His wife filed a domestic violence against him. They did not yet have a day in the court. My brother is planning to apply for a job. Will this case effect in any way, if the company that he is going to apply does a criminal background check. We have evidence to prove that she is lying, but could you tell the consequences of this on his job in future (i.e if things go in his favor or against him).

    Apparently there are TWO (2) cases going on. One is civil, the divorce. The other is criminal, the domestic violence. If he is convicted of the domestic violence, then it will show up on a background check, but not until then. If you have evidence she's lying, tell it to the judge.

    Some applications, however ask for arrests - not just convictions.

    A criminal background check won't reveal anything until he is actually convicted of something if he ever is. If you have "evidence to prove she is lying", be ready to spill it all out if and when your brother ever does get to court. If it's a job he's worried about and the job requires a background check then he needs to do everything in his power to not get convicted.
