    State vs me shoplifting charge, who will be there?
    So I will not be able to get a hold of my appointed attorney until Tuesday and I had a question.

    I was caught shoplifting at Wal-mart (in Indiana) and the LP officer for the store said he was unsure as to whether Wal-mart would be pressing charges but the state would be.

    I was taken to jail and had a meeting with the county judge, given my court date and told I was being charged with a Class D Felony as well as criminal conversion .

    Now, when time for court come since it's the state vs me and not Wal-mart pressing the charges will the LP officer/manager from Wal-mart be there?

    Also this is my first offense, What are the odds of doing jail time?

    I know these are all questions that I should (and will be) asking my attorney but I thought I would get some info in the meantime.

    Sorry the LP officer is giving you a line of bull. Walmart is pressing the charges, that happened when they called the police, the formal charges are always done by the state.

    And this had to be a lot more than a simple shoplifting for it to be a felony, or a very large amount of items.

    First you may have a lot of hearings, the first will be the first appearance ( if you have not already had that, or waived it when you made bail)

    But at some of the hearings merely the police officer and you and the attorneys and everyone else waiting for their trial sitting in the court room.

    At the real "trial" the clerk or LP that caught you, and the manager if he has evidence to testify to.

    Most likely if they caught you with the goods on you, and there is no way to get you out of it, the attorney will get a plea bargain and you never actually go to trial.
