    Sponsoring wife/bankruptcy
    I would like to sponsor my wife into Canada, Ontario. Back ground info: I was married Jan 2002 in the Phililppines I'm a Canadian Citizen. Had to file bankruptcy Jan 2003 which was never completed. Immigration says I must be discharged first, is there anyway around this?

    There is a 6 year statute of limitations for crediters to collect my debt and my credit rating should be wipe clean after this period as well. Can Immigration be force to use these laws so I can bring my wife?

    When you go bankrupt, the Bankruptcy and Insolvency Act imposes certain duties upon you. If you do not complete these duties, you do not get discharged. First time bankrupts are subject to discharge at the end of 9 months. If the duties are not completed, the trustee opposes your discharge. The discharge hearing can result in a conditional order (do what you haven't done and get a discharge) or a adjournment of the hearing (duties continue until there is another hearing). The trustee may obtain his/her discharge in the absence of your discharge reviving the rights of your creditors until such time as you eventually obtain the discharge.

    Contact your trustee and find out what duties you did not complete and do them. If there was a conditional order, after one year, you may apply to the court to vary the order to get a discharge.
