Well it was 14 checks over 6 months and I lived with himand they were for our son and to pay bills. He gave me permission and I can show they went to our bills. Also, he was paying my gym bills and insurance at the time. He's totally lying cause we broke up. The detective said it'she said she said. I was just wondering if I did go down for it and I have no prior criminal history what could happen wouldi go to jail or give me probation.

Most likely probation, they could do it as 14 separate charges ( misdmeanors) or maybe one crime since they were close together.

Gosh I hope so. I though it should be a family law matter. We are going to court for our son and he is using it to get custody of my son. I'm just scared to death. He handed me his checkbook and his atm. I just can't believe he's doing this. Most checks were under 400 hundred. There is one for 550. For my son's christmas. I'm just scared and it's not fair if I go to jail for something he gave me the full authority to do.

Well, it isn't family law, it's a criminal charge - but you already know that.
You signed the checks with his name?
My other thought would be whether one check appeared on a bank statement, your boyfriend ignored it and then you wrote MORE checks - indicating he did not "disapprove" of the first transaction. However, if all appeared on the same statement, yes, it will be "he said/she said."
The Court is going to wonder why your boyfriend simply didn't sign the checks if he wanted you to have the money/pay the bills/whatever they were for.

He would just give me his checkbook and tell me to take care of everything. It took him months later to even file on me while we are going through a custody battle with our son. He told me too, now he is being vindictive. I thought it was OK, I don't know the laws that well and I wouldn't have if I new I could get introuble for it. It was not my intent to break the law.I thought if a person gave you permission and gave you the checkbook it would go hand and hand and I figured we were living together and it was for our bills it would be OK. I didn't know.

Also, I memoed all the checks what they were for. Like smud bills it was in my name, it was his bill to he was using the utilities. My son's school supplies, school clothes, gym clothes to the high school, christmas, pg&e, and cable they were all labeled. It's not like I went to Macy's and hada shopping spree. It was for our child and bills that's it.

No matter what it's for the Court is going to wonder why if he wanted you to have use of the money he didn't simply write and sign the checks.
By the way - I'm on your side. I'm not arguing with you. These things happen. Unfortunately, situations like this can simply blow up in your face.

Did you forge his signature when you signed his checks?

It is he said/she said. You go to Court, present a good appearance, stick to the important details, don't go off on a sidetrack and explain things.
I believe you - hopefully the Judge will, too.

Thank you . I haven't been charged with anything yet it's still with the District Attorney whether they will file. I provided our bills, a notarized letter from him giving me permission to pick up his truck(which the detective liked). I'm just hopeing they will not file. He also lied and said I moved out before I did. Just a mess. But thank you, I think the detective believes me she's just doing her job.. good day nice chatting..
