    Miller Trust
Can someone please explain to me how the Miller Trust works? My brother had one drawn up for my mother who we are having to place in a nursing home. She makes over the amount allowed to be eligible for medicaid. My brother tells me that the money she makes through some small dividends, my father's social security, and army retirement are over the cap allowed for medicaid benefits, yet she doesn't make near enough to self pay at a nursing home. If certain monies are put in this trust, what happens to the small amount of money she has been able to save over the years? If my brother transfers all of the money she currently has in the bank into another account, can it be considered in respect to Medicaid eligibility? Help please. We are running out of time.

Revocable Trust (Grantor) Trust w/3rd party trustee [ 2 Answers ]

It was my understanding that if a grantor set up a revocable trust and a third party (let's say a bank) was named as trustee, the trustee was required to file a Form 1041. I am unable to locate any IRC or other guidance that would confirm or deny this. Please help. Thank you. Diana
