    Consent real estate line
    A man that owes me money has accepted that I put a consent lien on his house. I need to find out where to get the form or how to do it. I do not need to sue him he has agreed to this.

    Hello car:

    I think you DO need to sue him, because I don't think you can file a lien without a judgment.

    Besides, a judgment will give you access to his bank account and his wages... That way, you won't have to wait till he sells the house to collect. With a lien, you'll wait... and wait... and wait... and wait some more..

    If he's consenting then you can have him sign a note and mortgage. Then have the mortgage recorded. I suggest that you have this done by a title company or real estate attorney to make sure it's done right.
