    I want him out
    The father of my children and I have been living in our apartment for two years, he is always semi employed and has recently been let go from his job. He has been unemployed since Jan2009, I handle all the bills and the rent. We are no longer together and he refuses to leave the apartment because his name is on the lease. (even though I handle ALL of the bills ALONE). He said he will live there for as long as he wants or until I get him off the lease! What can I do to GET HIM OUT.. . ASAP. .

    Hello p:

    There's NOTHING you can do. He's entitled to the residence just as much as you are. Oh, you could sue him for his share... But, that's not going to get him out. You can MOVE, but the landlord will sue you both, and you'll be the one who pays...

    If there's physical violence, you could file for a restraining order... That'll keep him out... But, I certainly wouldn't lie about it.

    The question is are YOU on the lease. If you are not on the lease, you have no standing to remove him.

    For us to help we need to know who is signed on the lease and when the lease expires.
