    Canadian theft

    Hi Help Desk:
I got a phone call from orillia ontaio police officer asking me I found a wallet in casino rama, and my reply to him was no I did not found any wallet. But my sister dropped the wallet, and I picked up, and hide it inside my winter jacket. After she cashed her $10.00 coupon from the cashier, she realized that she lost her wallet, and than I gave it to her. But police was insisting me that it was somebody else wallet, and I have to go to the court. Now I got last Saturday a piece of paper from police officer, and he said that I am charged with theft under $5000.00. I have to go to the court, and I have to give the finger prints, and than attend the court. If I don't go, I will get arrested. I do not understand if some body lost their wallet, and if they see me in camera I am picking up the wallet, which was my sister wallet, getting me charge for. Please advise what should I do in this case? I have no crimenal record in my 32 year in Canada. I did not do anything wrong. Please reply

    Thanks

If it's a casino on sovereign land, it's by Indian rules.

SOMEBODY had to report it missing and charge you with theft. I very often held my husband's wallet, put it in my purse, when we were at the Casino. No one ever stopped me. How did the Officer get your name and phone number from the videotape?

I think you are leaving something VERY important out of your story.

If you didn't do anything wrong, then when you show up to court, all you have to do is be honest about the situation. Bring your sister to help you prove that it was her wallet. If the judge believes you, then he or she will discharge you and you will have nothing to worry about.

If it was your sister's wallet, then she's the only one who should be able to report a missing wallet to the police.

Are you sure you are not missing any facts?

If they went through enough video to see you picking up a wallet off the ground then they should also be able to find a piece of video where your sister drops a wallet in that exact spot if what you say is true.

Go to court and demand to see the video before and after you supposedly picked up a strangers wallet.

I get the feeling something isn't being said here too, cause I have a feeling they have video of the person who dropped the wallet also.

No I am not leaving any important story. For my view I am think they got my name and # from the cashier. Because we both cashed the coupon at the same time. So when you give the coupon to cash you have to give your ID to cash it. But this is wrong. They can see in the camera, that I was giving her a wallet. Why they are telling me that was somebody else. May be that day some one lost the wallet, and ploice is thinking that I picked up my sister wallet was another person wallet. Please reply

    Thanks

Back to what I asked you originally - who filed a report that the wallet was stolen? The Police cannot simply arrest you for picking up a wallet and putting it in your pocket. It has to be stolen.

Your sister would go to Court with you, explain it's her wallet, you gave it back. End of story UNLESS the video is clear enough to determine the wallet you picked up is NOT hers. I would assume she still has the same wallet to show the Judge.

This still makes no sense to me. I don't even understand why if your sister dropped her wallet you would pick it up and put it in your coat instead of saying, "Here, you dropped your wallet."
