    Info reg valid status
    My wife is 24weeks pregnant and my company is asking me to go back to our country of origin. She is on L2 and me on L1a, our visa got exired in 2008 but our I-94 was extended which is valid till 2011.

    If I leave my company will my status be invalid? If not till how many days can I stay here before I get deported?
    If I continue with company and go back to my country but my wife stays here till she delivers, will her status be valid?
    Can I apply for visitor visa on my own and join her back here?



    I understand there will be insurance issue, but money is not a problem and I can pay even w/o insurance.

    Please advise.

    The L visa is an employer-specific visa, so if you leave the company, your L status expires at that moment, and the L-2 dependent visa at the same time.

    Your wife cannot stay in the US as an L-2 if you are not an L-1. look for another NIV for her, maybe an F student visa.

    You can always apply for a different visa, but you need to prove to the CONOFF that you qualify and will not violate the terms of that visa. Consult with an experienced immigration attorney, good luck.
