    VOP - 1st violation
    My son has just gotten his 1st VOP. What are the Florida State Statutes?

    Hello l:

    I don't know what you need the statutes for... He can be sent back to prison for his entire sentence or just part of it. Time spent on probation doesn't count. For example, if he were violated on the last day of his probation, he could be made to serve his entire sentence - NOT just one day.

    So, instead of asking about the statutes, you should have asked us what you can do to help your son... Even though you didn't ask, I'm going to answer anyway...

    The punishment for a violation is NOT written in stone. Therefore, there is a LOT that can be done NOW to effect the eventual outcome. Therefore, I'd hire a lawyer...

    I talked with my PO and Judge a lot today about this and this is how they base punishment. They take the violators history into account, before and during probation, fines and fees owed, job status, and how the violated their probation.

    If you could be more descriptive then I'm sure we could give you a better answer. You could probably get a free consultation from a local lawyer as well...
