    Marital Property Or Not
    I got married in 1993, and separated in 2001. I just now found out that my husband had acquired property in 1999 with out my knowledge of it. Reason I found out about it is due to it is posted in a family member's News Paper of the property being Sold for 84,589.00, and I was sent a copy from them about it. Now we are not divorced as of this time yet due to he refused to give me a divorce. Plus hides so papers can not be served to him. He is back 3 yrs on child support among many more things. My question is do I have any rights to the property he just sold, or to any of the money from the sale of this property? I would assume it would be marital property being he acquired it during the time we lived together during our marriage, even with out my knowledge of it. From what I have found of the property information it belonged to his grandparents and was put into the names of 3 grandchildren upon their death, but no disclosure of what was paid, or if any was, just shows $1.00. In which when I questioned this, I was told they put $1.00 to disclose of how much paid or if any was. Now been sold by 2 of them ( due to 3 person died ) to another party. This property is located in Pennsylvania, so I am not sure of laws there due to I live in Missouri.

    If you have any help for me it would be appreciated. I want to know if it is worth my time to pay for a lawyer or if I would be wasting my time on this.

    If it was property acquired during the marriage and you are in a community property state, then you would be entitled to a share of his share of the proceeds of the sale.

    But since the sale has gone through and the money problably already hidden, you probably can't get at it yet. Save the family newsletter and show it to you lawyer to make sure its included in marital assets. To be considered during the divorce.
