    Birth mother or fathers surname
    In an unmarried situation who gets to chose the child's surname - the birth mother - or the father

    What happened to my previousquestion in the same category

    If the father signs birth certificate in hospital that he is the father, the baby takes his surname. If he fails or does not want to sigh, the baby takes your surname.

    In the US, the mother chooses ALL names, regardless of paternity, marital status, the father being present and signing the birth certificate.

    The father can challenge the naming in court at a later date, but it's a hard battle for a minor gain in most cases.
