    Terminating biological fathers rights
    Can I terminate my daughters biological rights without his consent in Oklahoma because he hasn't paid child support or seen her in 9 years?

    The short answer is No.

    Get a lawyer, they will be able to help you determine what you can do to get the child support order enforced.

    Generally you cannot terminate rights due to lack of support, and in most states you can't terminate at all unless there is someone waiting to adopt the child.

    Basically, its extremely difficutl to terminate parental rights especially involuntarily. However, since you posted this in the Adoption forum, I'm wondering if you want the TPR to clear the way for an adoption. That is one of the few reasons a court will grant a TPR.

    But if he won't consent, then you hasve a problem. Your best bet is to push for back child support unless he agrees.

    Yes my new husband is wanting to adopt my daughter. My ex husband I can not find and his father will not tell me where he is.

    You will NEED an attorney to prepare the adoption petition. Your attorney will tell you what steps you need to take to get his rights terminated if you can't find him. You have to show a good faith effort to contact him and get him to relinquish rights. Tell his father that if he comes forward and signs he won't be respondible for child support anymore. But if your good faith efforts fail to locate him, you can get a TPR so your husband can adopt.
